Terms of Service

Welcome to Peeksake. These Terms of Service ("Terms") govern your access to and use of the Peeksake mobile application ("App"), website, and related services (collectively, the "Service") provided by Peeksake ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Account

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

4. The Service

Peeksake allows you to visit designated locations ("Peek Spots"), take photos, and use our proprietary tools to transform those photos into unique digital keepsakes and postcards. The Service also includes a coin-based economy for unlocking features and optional physical printing through the Peeksake Print Shop.

5. Coins and Purchases

The App uses a virtual currency ("Coins") to unlock keepsakes and other features. Coins may be earned through gameplay or purchased via in-app purchases through the Apple App Store or Google Play Store.

  • Coins have no real-world monetary value and cannot be exchanged for cash.
  • All coin purchases are final unless otherwise required by applicable law or the policies of the respective app store.
  • We reserve the right to modify coin pricing, earning rates, and redemption values at any time.

6. User Content

You retain ownership of the photos you take through the App. By using the Service, you grant us a limited, non-exclusive, worldwide license to process your photos through our systems to generate keepsakes and postcards. We do not claim ownership of your original photos.

Keepsakes created from your photos are provided to you for personal, non-commercial use. You may share them with friends and family through the App's features.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is offensive, harmful, or infringes on the rights of others
  • Attempt to manipulate location data or bypass location verification
  • Reverse-engineer, decompile, or disassemble the App
  • Use bots, scrapers, or automated tools to interact with the Service
  • Resell or commercially exploit keepsakes or other content from the Service without our written consent

8. Intellectual Property

The App, its design, features, proprietary technology, and all related content are the property of Peeksake and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Location Services

The Service requires access to your device's location to verify proximity to Peek Spots. By using the App, you consent to the collection and use of location data as described in our Privacy Policy.

10. Print Shop Services

Physical prints ordered through the Peeksake Print Shop are subject to availability and additional terms that may apply at the point of purchase. Print quality and delivery timelines may vary.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that generated keepsakes will meet your expectations, or that the Service will be uninterrupted or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Peeksake shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of coins, or inability to access features.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately. Any coins or content associated with your account may be forfeited.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
